The short version

  • These terms are the contract between you and Cars Rule Ltd when you buy from CREAM
  • Your order is an offer — the contract forms when we dispatch it
  • Everything is made to order, so please check the size guide before you buy
  • Nothing here reduces your statutory rights as a consumer

1. Who we are

CREAM is operated by Cars Rule Ltd, company number 16377364, registered at 109-111 Fulham Palace Road, London, England, W6 8JA. Our VAT number is GB519969431. Contact us at shop@carsrule.co.uk.

In these terms, "we", "us" and "our" mean Cars Rule Ltd. "You" means the person buying from us.

2. These terms

By placing an order you accept these terms, together with our privacy policy, shipping policy and refund policy. Please read them before you buy.

We may change these terms — the version that applies to your order is the one published when you placed it, so changes are never applied backwards.

You must be at least 16 to order, and able to pay with a card in your own name or with permission from the cardholder.

3. How a contract is formed

This matters more than it sounds, because everything is printed to order.

  1. You place an order at checkout. That's an offer to buy, not a contract.
  2. We email you an order confirmation. That confirms we've received the order — it still isn't acceptance.
  3. We accept your order, and the contract forms, when we dispatch it. We'll email you at that point.

If we can't accept your order — the design sells out, the artwork fails on the garment, we can't ship to your country, or we spot an error in the price — we'll tell you and refund you in full. We won't have to compensate you beyond that refund.

4. Prices and payment

  • Prices are in pounds sterling and include UK VAT.
  • Delivery is charged on top, and shown at checkout before you pay. See our shipping policy.
  • Orders outside the UK may attract import VAT, duty and a carrier handling fee on arrival. Those are yours to pay and aren't included in what you pay us.
  • We take payment when you order. If the payment fails, we won't dispatch.

Pricing errors. We try hard to price correctly, but if an item is listed at an obviously wrong price — a decimal in the wrong place, a £3.50 tee — we don't have to sell at it. We'll contact you before dispatch and give you the choice of paying the correct price or cancelling for a full refund.

5. Made to order

Every CREAM garment is printed once you order it. Nothing sits in a warehouse, which keeps waste down but means we need up to 5 working days to make your order before it ships.

Being made to order does not make your order a personalised item. Our garments are standard designs from our catalogue, so you keep the full right to cancel set out in our refund policy.

6. What you're buying

We photograph and describe our products as accurately as we can, but:

  • Colours vary between screens. A garment may not match your monitor or phone exactly.
  • Garments are made by hand. Small variations in print placement, tone and finish are normal and aren't faults.
  • Sizing varies by style. Please use the size guide on each product page — it's measured from the actual garment, not a generic chart.
  • Care matters. Follow the care instructions on the label. Damage from washing a garment against those instructions isn't a fault.

If something genuinely is faulty, damaged or not what you ordered, you're covered — see §4 of our refund policy.

7. Delivery, cancellation and returns

Delivery times, costs and customs are in our shipping policy.

Your right to cancel, how to return something, and how refunds work are in our refund policy. In short: you have 14 days to change your mind, and you need to email us for a return address before sending anything back.

Goods are your responsibility once they're delivered to the address you gave us. Risk passes to you at delivery; ownership passes once we've been paid in full.

8. Our designs

The CREAM name, the artwork on our garments, our photography and the content of this site belong to us or are used with permission. Buying a garment buys you the garment — it doesn't transfer any rights in the design.

You're very welcome to wear it, photograph it and post it. You can't reproduce our artwork on your own products, resell it, or use our branding commercially without asking us first.

9. Using this site

Please don't attempt to break, overload or gain unauthorised access to the site, scrape it, or place orders fraudulently. We can refuse or cancel orders, and restrict access, where we reasonably believe that's happening.

If you post a review or send us a photo, you keep ownership of it, but you give us permission to use it to promote CREAM. Only send us things you have the right to share.

10. Our responsibility to you

If we fail to meet these terms, we're responsible for loss or damage you suffer that's a foreseeable result of that failure. We're not responsible for loss or damage that isn't foreseeable.

We never limit or exclude our liability for:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation
  • defective products under the Consumer Protection Act 1987
  • your statutory rights under the Consumer Rights Act 2015 — that goods are of satisfactory quality, fit for purpose and as described
  • anything else the law doesn't allow us to exclude

We supply our products for domestic and private use. If you use them commercially we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

11. Things outside our control

We're not responsible for delays or failures caused by events beyond our reasonable control — carrier and postal disruption, customs delays, supplier or print failures, extreme weather, fire, flood, power or network outages, industrial action, or government restrictions.

If one happens we'll tell you and do what we reasonably can to limit the delay. If it's substantial, you can cancel and we'll refund anything you've paid for goods not yet dispatched.

12. General

  • We may transfer this contract to another business, and we'll tell you if we do. Your rights won't be affected.
  • You may only transfer your rights under it with our written agreement.
  • This contract is between you and us. Nobody else can enforce it.
  • If a court finds part of these terms unlawful, the rest continues to apply.
  • If we don't insist on something straight away, or delay in enforcing it, that doesn't stop us doing so later.

13. Complaints

Email shop@carsrule.co.uk with your order number and we'll work it out. If we can't resolve it, UK customers can take the complaint to Citizens Advice (citizensadvice.org.uk, or 0808 223 1133), who can refer it to Trading Standards.

14. Governing law

These terms are governed by the law of England and Wales, and disputes can be brought in the courts of England and Wales.

If you live in Scotland or Northern Ireland, you can also bring proceedings in your own courts. If you're a consumer outside the UK, nothing here removes the mandatory protections of the country you live in.

15. Your statutory rights

Nothing in these terms affects your statutory rights.
